The Website is provided by BlackVault Technologies, ABN 37 622 309 540 of Brisbane, Queensland, Australia, trading as BlackVault Technologies. BlackVault™ is a trade mark used by that business. In these Terms of Use, “BlackVault”, “we”, “us” and “our” refer to MVP Ventures Pty Ltd trading as BlackVault Technologies — a single legal entity, not a separate operator. By accessing or using the Website, you agree to be bound by these Terms of Use. If you do not agree, you must not use the Website.
About BlackVault™
BlackVault™ is a sovereign AI infrastructure service. The Website provides general information about BlackVault™, including its architecture, compliance governance framework, and sector applications. Nothing on the Website constitutes an offer capable of acceptance, and no contract for the supply of any BlackVault™ service is formed through your use of the Website. A binding engagement is only created upon execution of a separate written service agreement between the relevant contracting entity and a client.
Use of the website
You may use the Website for your own personal or internal business purposes, including to evaluate whether to engage BlackVault™. You must not:
- ·use the Website in any way that breaches any applicable law or regulation;
- ·attempt to gain unauthorised access to the Website, our systems, or any account;
- ·introduce any virus, malware, or other harmful code to the Website;
- ·reproduce, copy, modify, distribute, or create derivative works from any part of the Website except as permitted under section 4; or
- ·use any automated system, including scraping tools, to access the Website without our prior written consent.
Intellectual property
All content on the Website — including text, graphics, the BlackVault™ name, logo and wordmark, and the descriptions of our architecture methodology, compliance governance framework, sector compliance modules, and product guarantees (together, the “Content”) — is owned by or licensed to us and is protected by Australian and international intellectual property laws. “BlackVault” and the BlackVault™ device are trademarks used by MVP Ventures Pty Ltd trading as BlackVault Technologies. Except as expressly permitted by these Terms of Use or by law, you must not reproduce, distribute, publish, or create derivative works from any Content without our prior written consent.
No professional or legal advice
Information published on the Website, including descriptions of regulatory frameworks such as the Privacy Act 1988, APRA prudential standards, the NDIS Act, Aged Care Quality Standards, the My Health Records Act, the Legal Profession Uniform Law, and the Australian Government Information Security Manual, is provided for general information only. It does not constitute legal, compliance, or other professional advice and should not be relied upon as such. Compliance documentation prepared by BlackVault™ for a client describes the technical and operational controls of that client’s deployment; it does not constitute an opinion on whether those controls satisfy the client’s legal obligations. You should obtain your own independent legal and professional advice before making decisions based on Website content.
Product guarantees
The four product guarantees described on the Website are contractual commitments given to clients under a signed BlackVault™ service agreement, supported by the technical controls and evidentiary documentation described in that agreement. Their description on the Website is general information about our service standard and does not, by itself, constitute a warranty or representation to any person who has not entered into a service agreement with us.
Accuracy of information
We take reasonable care to ensure information on the Website is accurate and current, but we do not warrant that it is complete, accurate, or up to date. Website content may be changed, updated, or removed at any time without notice. To the maximum extent permitted by law, we exclude all warranties, express or implied, in relation to the Website and its content.

Indemnity

Availability of the website

Enquiries and requests for an Infrastructure Assessment
Submitting an enquiry or a request for an Infrastructure Assessment through the Website does not create any obligation on BlackVault™ to provide services and does not create a client relationship. Any engagement is subject to a separate scoping process and execution of a written service agreement.
Governing law and jurisdiction
These Terms of Use are governed by the laws of Queensland, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of Queensland and the courts competent to hear appeals from those courts.
Severability
If any provision of these Terms of Use is held to be invalid or unenforceable, that provision will be severed, and the remaining provisions will continue in full force and effect.
Variation
We may vary these Terms of Use at any time by publishing updated terms on the Website. Your continued use of the Website following any variation constitutes acceptance of the varied terms.
Entire agreement
These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and BlackVault™ in relation to your use of the Website, and supersede all prior representations, understandings, or arrangements.
